1. Who We Are

Amae Travel Designers (“Amae,” “we,” “us,” “our”) is a boutique agency that designs bespoke luxury travel experiences. These Terms govern your use of the website https://www.amaetraveldesigners.com (the “Site”) and the booking of our services (the “Services”). By accessing the Site or booking with us, you agree to these Terms.

2. Scope of Service

We design and coordinate personalized itineraries through independent third-party providers (airlines, hotels, local operators, transportation, insurance, etc.). Amae is not an airline, hotel, or tour operator; we act as an intermediary between the traveler and the provider.

3. Quotes, Pricing, and Payments

  • Quotes: Prices are estimates until confirmed and may change based on availability, exchange rates, taxes/fees, and provider policies.
  • Deposits: To secure services, a non-refundable deposit of 30% (or as required by the provider) is due at the time of confirmation.
  • Final Payment: Must be paid no later than 30 days prior to the trip start date. If payment is not received, reservations may be cancelled and provider penalties may apply.
  • Currency and Fees: Transactions may be settled in U.S. dollars, or Dominican pesos. Bank/processor fees and exchange-rate differentials are outside Amae’s control.

4. Changes, Cancellations, and Refunds

  • If cancellation is made more than 30 days before departure, the total amount paid will be refunded minus the non-refundable initial deposit and any costs already incurred with third parties (hotels, flights, transfers, etc.).
  • If cancellation occurs between 15 and 30 days before departure, 50% of the total amount will be retained.
  • For cancellations within 15 days of departure, no refund will be issued.
  • In the event of cancellation due to force majeure (natural disasters, armed conflicts, public-health emergencies), Amae Travel Designers will assess each case individually and will seek to reschedule the trip or negotiate more flexible terms with providers.
  • Changes to dates, names, or other details are subject to availability and may incur additional fees imposed by providers.
  • The original price and conditions are not guaranteed after a modification.

5. Travel Documents, Health, and Entry Requirements

Travelers are responsible for obtaining valid passports, visas, vaccination certificates, minor consent forms, and all immigration/health requirements for each destination. Please consult the relevant embassy/consulate.

6. Travel Insurance

Amae strongly recommends comprehensive travel insurance (medical, trip cancellation, baggage, liability). Declining coverage means you accept the related risks.

7. Conduct and Responsible Travel

You agree to:
a) comply with local laws and customs;
b) respect provider rules;
c) avoid unsafe conduct; and
d) promptly report significant incidents to Amae.

8. Liability

  • Amae acts as an intermediary and is not responsible for acts, omissions, delays, or defaults by third-party providers.
  • To the extent permitted by law, Amae will not be liable for indirect, incidental, punitive, or consequential damages, including loss of profits.
  • Where liability cannot be excluded, Amae’s total liability will not exceed the service fees received by Amae for the specific Service giving rise to the claim.

9. Wedding Registry (Gift List)

  • The registry allows friends and family to make contributions that fund experiences within your itinerary (e.g., sunset dinners, upgrades, activities).
  • Funds received are applied to your trip according to your instructions and the provider’s terms; some services may be non-refundable.
  • If the trip is cancelled or modified, refunds are governed by provider policies and by any purchased insurance. Amae does not guarantee refunds for amounts already applied to non-refundable services.

10. Intellectual Property

All content on the Site (text, trademarks, images, video, design) is owned by Amae or used under license. You may not copy, distribute, modify, or exploit the content without prior written permission.

11. User Content and Testimonials

If you submit reviews, images, or testimonials, you grant Amae a non-exclusive, worldwide, royalty-free license to display and use such content for promotional purposes, in accordance with our Privacy Policy.

12. Privacy and Cookies

Personal data is processed in accordance with our Privacy Policy and Cookie Policy available on the Site. By using the Site or making a booking, you consent to such processing.

13. Communications

We may contact you by email, phone, or messaging regarding your itinerary, reminders, updates, and satisfaction surveys. You can adjust your preferences via our emails (unsubscribe links) or by contacting us.

14. Accuracy and Availability

We strive for accuracy; however, typographical errors or changes in availability may occur from time to time. We reserve the right to correct and update information without prior notice.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Dominican Republic. The parties submit to the exclusive jurisdiction of the courts of Santo Domingo, Dominican Republic, and waive any other forum.

16. Changes to the Terms

Amae may modify these Terms as needed. The current version will be published on the Site with an updated date. Continued use of the Site or the Services constitutes acceptance of the changes.
